Proper Mediation
Proper Mediation
The court increasingly requires disputing parties to try to resolve their differences using alternative dispute resolution, especially mediation.
Proper Mediation is geared to giving parties a real opportunity of reaching an actual resolution to a difficult dispute.
When a Judge directs you to try ADR, unless you have an excellent reason not to engage, you ought to have a plan to avoid a trial and exit your litigation on acceptable terms.
Proper Mediation was established by Lee Stutt, one of the South West's most experienced litigators, to allow litigants their best opportunity of reaching a conclusive resolution.
I am a registered, accredited mediator with the Civil Mediation Council, which governs and regulates civil mediators in the United Kingdom, with registration number 2345.
I bring 20+ years of litigation experience and multiple reported cases as litigator and legal representative to bear on the process, including 2 leading probate precedents and 3 in property law.
I specialise in hard cases and conjuring positive outcomes for clients where none were expected. I work tirelessly to achieve a resolution, but if none can realistically be achieved despite all efforts, I fully endorse the right to a trial. See more about me and my background, here.
Proper Mediation injects pragmatism and commercial realities into the dispute, putting the right legal questions to the representatives, ensuring that nobody proceeds on the basis of unrealistic arguments and fanciful expectations, to produce an agreement that everyone can accept with finality, and then move on.
Proper Mediation has full regard to the underlying litigation, not mediation for mediation's sake, getting to the bones of the dispute.
We can do it properly in person, at a site visit or in offices, or online by Zoom. See my questions and answers as a guide for what to expect and on the process.
Our Agreement to Mediate governs the terms and basis of my appointment and we make it freely and transparently available in the menu above. We work under the CMC's fixed fee scheme. Otherwise, our prices are negotiable but our introductory proposed fee is currently £1,000 per party per day for most mediations, and we will stay until there is nothing more to contribute. We are fully insured to £1m with Hiscox.
